In all modern states, some land is held by central or local governments. This is called public land. The system of tenure of public land, and the terminology used, varies between countries.

Most of the public land held by the U.S. National Forest Service and Bureau of Land Management is in the Western states. Public lands account for 25 to 75 percent of the total land area in these states.[1]

The National Forest Service alone holds 193 million acres (780,000 km²) nationwide, or roughly 8% of the total land area in the United States.[2]
In the United States governmental entities including cities, counties, states, and the federal government all manage land which are referred to as either public lands or the public domain.
The majority of public lands in the United States are held in trust for the American people by the federal government and managed by the Bureau of Land Management (BLM), the United States National Park Service, Bureau of Reclamation, or the Fish and Wildlife Service under the Department of the Interior, or the United States Forest Service under the Department of Agriculture. Other federal agencies that manage public lands include the National Oceanic and Atmospheric Administration and the United States Department of Defense, which includes the U.S. Army Corps of Engineers.
In general, Congress must legislate the creation of new public lands, such as national parks; however, under the 1906 Antiquities Act, the President may designate new national monuments without congressional authorization.
Each western state also received federal "public land" as trust lands designated for specific beneficiaries, which the States are to manage as a condition to acceptance into the union. Those trust lands cannot any longer be considered public lands as allowing any benefits to the "public" would be in breach of loyalty to the specific beneficiaries. The trust lands (two sections, or about 1,280 acres (5.2 km2) per township) are usually managed extractively (grazing or mining), to provide revenue for public schools. All states have some lands under state management, such as state parks, state wildlife management areas, and state forests.
Wilderness is a special designation for public lands which have been completely undeveloped. The concept of wilderness areas was legislatively defined by the 1964 Wilderness Act. Wilderness areas can be managed by any of the above Federal agencies, and some parks and refuges are almost entirely designated wilderness. A wilderness study area is a tract of land that has wilderness characteristics, and is managed as wilderness, but has not received a wilderness designation from Congress.
Typically each parcel is governed by its own set of laws and rules that explain the purpose for which the land was acquired, and how the land may be used.
The private uses of public lands continues to be a challenging issue in the United States. Environmental groups have used the Public Trust Doctrine to re-establish rights to common resources such as water in the arid west and in Hawaii. An expanded vision of the Public Trust doctrine that includes soils, air and other species has been argued. Recreation on U.S. public lands

Most state- and federally managed public lands are open for recreational use. Recreation opportunities depend on the managing agency, and run the gamut from the free-for-all, undeveloped wide open spaces of BLM lands to the highly developed and controlled national and state parks. Wildlife refuges and state wildlife management areas, managed primarily to improve habitat, are generally open to wildlife watching, hiking, and hunting, except for closures to protect mating and nesting, or to reduce stress on wintering animals. National forests generally have a mix of maintained trails and roads, wilderness and undeveloped portions, and developed picnic and camping areas.

Grazing on U.S. public lands

Historically in the western United States, most public land is leased for grazing by cattle or sheep. This includes vast tracts of National Forest and BLM land, as well as land on Wildlife Refuges. National Parks are the exception. This use became controversial in the late 20th century as it was examined by environmentalists. [3]

THE STARTING POINT - THE PREAMBLE TO THE CONSTITUTION OF THE UNITED STATES

"We the people of the United States, in Order to form a more perfect Union, establish Justice, insure domestic tranquility, provide for the common defence, promote the general welfare, and secure the blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America."

In this one sentence the American people established themselves as sovereigns in common and established a government as the means by which we exercise our common sovereignty.

PRIVATE PROPERTY RIGHTS
As the nation’s territory grew, some public lands and waters were divested into private ownership. By a variety of laws, including the 5th Amendment, private property rights were legally secured. Private property is a strongly held value in our society and we have passed a myriad of laws dealing with these private rights – none of which legalize the taking of public property.

PUBLIC PROPERTY RIGHTS
The root concept of ‘property’ in English common law included the premise that the owner of property is entitled to defined benefits of ownership. This premise underlies our legal code of private property rights. and also underlies the public property rights - the property of the commonwealth. The benefits of property owned by the people of a commonwealth accrue to the owners..

The logic of property ownership in our general culture, common law, and written code of law secures the rights of publics to the benefits of their property as securely as it does the rights of private property owners. There is no law in our national or state code that classifies public property right below private property rights. I am surprised there is not a category under this heading.
I feel there should be.
I am sure there are rockhounds out there that have came across some illegal situations, but with no title
place to put it, it gets put on the back burner, and eventually becomes forgotten about.
The entry I make here is in reference to a possible illegal cabin construction in the Black Hills.
One has to stumble upon it to find it! It is, according to the Black Hills Map, 2008 edition, the entire area around this cabin is Black Hills Forest. I have the update to the map and it does not show a private ownership of the land in this area.I am going to check with the Forest Service if they are aware of this cabin, and if it is indeed built illegally. There are no roads to this cabin, not as much as a bike trail. It has been built into a large crevice of a rock and only 2 1/4 sides can be seen. It is definitely an out of the way area. If the Forest Service confirms it is an illegal construction on Forest Service Land,I plan on turning all the pics I have and information over to them. No I have not been a 100% square shooter in my life, but I have been for the last 35 years! If it is a wrongful contruction, it needs to be addressed. It is in the Palmer Gulch area in the Black Hills, and a two mile hike from the nearest road. I discovered this at the end of the 2008 season, and like I mentioned above, it was put on the back burner and forgotten until tonight I was cleaning up some old files. I am posting a pic on the picture page and putting it into my album.

Rockhounds and outdoor recreational enthusiasts are encouraged to publicly comment on the Proposed Action of the Okanogan-Wenatchee USFS to "Designate a mix of motorized and non-motorized opportunities that provide quality experiences and protect the natural resources"
Comments need to be received by May 7th to receive consideration. The following link provides additional info on this proposed actions can be seen at the following

This seems so innocent on the surface yet could possible have serious implications when it comes to the question of access, both for the abled & disabled. All users of these lands near and afar should be aware and on alert.
